General Terms and conditions of sale


1. The seller

In the present general terms and conditions of sale, the seller is designated by the term Ooplaboo. Ooplaboo is the commercial name of the products that are sold and produced by the company Upturn sprl.

This commercial company was founded on 28/08/2014 and is managed by Virginie FRAIPONT. It is registered in the Crossroads Bank for Enterprises (CBE) under the number 0560.716.022. Its business headquarters are situated at 5, allée Marie-Louise in 4121 Neupré (Belgium).

Every question about these general terms and conditions of sale, the ordering/delivery methods or the aftersales service can be sent by ordinary mail to the address above, by e-mail to info@ooplaboo.be.

Any order implies the acceptance by the customer of our general terms and conditions of sale.

2. The user/the buyer

The user is any person using the website, be it by simply navigating it or for placing an order. The user who places an order and makes a purchase on the website is deemed to be of full age and responsible for his or her purchase. The buyer is any person having placed an order on the website.

3. General terms and conditions of sale

These Conditions of Sale are intended to define the rights and obligations of the parties (the seller and the user) within the framework of distance selling on the commercial website www.ooplaboo.be

These Conditions of Sale are the only ones that apply, unless previously agreed to otherwise in writing by Ooplaboo. They are deemed to have been tacidly accepted by the user of the site. They can be changed by Ooplaboo at any time. Changes will be enforceable as of the moment they are put online on the website, apart from orders passed before these changes.

4. Price

Prices are in euros and are VAT included.

The articles are billed on the basis of the tariffs that are in force at the moment of the validation of the order. They take into account possible discounts that are applicable on the day of the order.

Prices are excluding delivery. The charges are indicated on the summary before validation by the customer. They will hence be billed as well after the final validation of the order.

The prices mentioned on the website are susceptible to variations due to launch, promotion or sale prices.

Ooplaboo reserves the right to refuse an order if the price mentioned on the website turns out to be wrong due to a technical or human error.

5. Products

The products sold by Ooplaboo are those on the website, on the day the user consults the website within the limits of the available stock.

All our products are covered by a 2-year warranty for any manufacturing defect. Any return and reimbursement will only take place after validation of the defect by Ooplaboo.

6. Orders

Any order commits the buyer, but only commits the seller after confirmation in writing, delivery or billing from the latter.

All products are deemed to be in stock. Should that not be the case, the indicative term for restocking will be mentioned in the product description.

7. Payment

An overview of the order is sent to the buyer by electronic mail to the address provided by him in the minutes following the validation of the order.

The price owed by the buyer is the amount mentioned on the overview of which he or she has taken note prior to validating his or her order.

Payments are done by bank transfer onto account Belfius IBAN BE32 0689 0048 7302 in the name of the company Upturn sprl.

The payment has to be done in full when an order is placed. If payment is not received within 5 days following the validation of the order, it will be cancelled.

The order will be sent upon receipt of payment.

8. Shipping

Ooplaboo will make every effort to send the order within 3 working days following receipt of payment.

The buyer is informed of the delivery charges at the moment the order is confirmed and on the summarising order form.

The orders are packaged with the utmost care in order to guarantee the initial state of the product. The customer commits to verifying his or her order's conformity upon receipt.

In case of complaints concerning the state in which the articles were delivered to you or in case of missing articles, the buyer will have to raise this at the latest 14 working days following receipt of the order by electronic mail to the address info@ooplaboo.be.

Except if there is a legitimate reason, any complaint expressed after the 14 working days following receipt of the products shall be deemed inadmissible.

If within 7 working days after the parcel was given to the carrier/to the company responsible for delivery, it has not arrived at the buyer, the latter will notify Ooplaboo in writing (e-mail or letter) who will carry out the appropriate research to locate the parcel.

We cannot be held liable for a delay in the execution or the non execution of our engagements due to circumstances beyond our normal control (delays in transport, strike, work interruptions)…

9. Returns

The buyer has the right to send the article back to the seller without justification within 14 days following delivery. The return charges are at the expense of the buyer and will not be reimbursed.

Beyond this delay, Ooplaboo will no longer accept any complaint or return of merchandise. The articles have to be sent back in their original packaging, with all the labels, non worn and non washed to the following address: Ooplaboo, Service Client, 5 Allée Marie-Louise 4121 Neupré, Belgium.

Returned articles will be reimbursed at the latest 10 days after they will have been received.

Defective or wrong items shall be returned at the expense of Ooplaboo who will completely reimburse the return charges.

10. Applicable law and competent jurisdiction

Any dispute between the seller and the buyer regarding the contract and its execution shall be governed by Belgian law in general and by the present general terms and conditions in particular. In case of a dispute, the judicial district of Liège shall be exclusively competent.

The entire website and its contents are the exclusive property of Virginie Fraipont. Any reproduction, use or exploitation of the website contents is strictly forbidden. The photos on the website can only be used with the consent of Upturn sprl.

In order to improve and facilitate the user's surfing experience, the website uses cookies to save the necessary information for the good functioning of the website, and this only during your visit. This information, which is saved in your computer, will automatically be deleted by your browser.

The personal data of the users of the website are saved to manage the orders. Ooplaboo respects the online privacy No personal information will be collected without your knowledge, nor forwarded to third parties.

Only the data of the persons explicitly having given their consent to receive commercial information will be used for direct marketing. All of this data will be treated in accordance with the stipulations of the Act of 8 December 1992 regarding the protection of privacy. The user has the right to rectify and delete his or her data at any time and free of charge.
